Terms of Service

1. Acceptance of Terms

By accessing or using Sokosuite ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including business owners, employees, and administrators.

2. Description of Service

Sokosuite is a cloud-based retail management platform that provides point of sale, inventory management, accounting, and related business tools. The Service is provided on a subscription basis with different tier levels offering different features.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

• Subscriptions are billed monthly in Kenya Shillings (KES).
• Payment is accepted via M-Pesa and bank transfer.
• A 14-day free trial is provided for new accounts.
• You may upgrade, downgrade, or cancel your subscription at any time.
• Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial billing periods.

5. Your Data

You retain ownership of all business data you enter into Sokosuite. We do not claim ownership of your data. You grant us a limited licence to store, process, and display your data solely for the purpose of providing the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious code or attempt to disrupt the Service
• Resell or redistribute the Service without our written consent
• Use the Service to store or transmit content that violates Kenyan law

7. KRA eTIMS Compliance

Sokosuite provides tools to help you comply with KRA eTIMS requirements. However, you remain responsible for the accuracy of your tax information, KRA PIN, and compliance with all applicable tax laws. Sokosuite is not a tax advisor and does not provide tax advice.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. The offline POS functionality ensures you can continue selling even during service interruptions.

9. Limitation of Liability

Sokosuite is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost profits, data loss, or business interruption.

10. Termination

We may suspend or terminate your account if you violate these terms. Upon termination, your data will be available for export for 90 days, after which it will be permanently deleted.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
